Constitutional Basis and Independence

Article 6, Section 2 of the Indiana Constitution establishes the position of County Sheriff as an elected office. The Sheriff, along with other county officials such as the Clerk of the Circuit Court, Auditor, Recorder, Treasurer, Coroner, and Surveyor, is chosen by the voters during general elections. The Sheriff serves a term of four years and cannot hold office for more than eight years in any twelve-year period. This structure guarantees both independence and accountability, making the Sheriff a key public servant and leader in county law enforcement.

Primary Duties of the Sheriff

The elected Sheriff leads the Sheriff’s Office in several crucial areas:

Law Enforcement

  • Enforces both state laws and county ordinances

  • Investigates crimes and arrests suspects

  • Provides law enforcement services, especially in unincorporated areas without  police departments

Jail Management

  • Operates and maintains the county jail

  • Oversees the custody, care, and transportation of inmates

  • Handles booking and detention for county and, at times, municipal arrests

Court Duties

·         Serves legal documents, including subpoenas, eviction notices, and court summons

·         Executes court orders such as property seizures and foreclosures

Civil Process Service

  • Delivers various legal documents, including:

  • Divorce papers

  • Protective orders

  • Garnishments

Emergency Response and Community Support

  • Coordinates with other agencies during emergencies or disasters

  • Provides mutual aid to other police departments as needed

  • Manages warrants and extraditions

  • Participates in community policing and crime prevention programs
